Une marque générique est une marque monopole ou leader sur son marché qui va entrer progressivement dans le vocabulaire commun pour désigner sa catégorie de produit.
Voici quelques exemples qui vont peut-être vous surprendre…
- Caddie
Le premier Caddie voit le jour en 1957, en France puis dans plus de 75 pays. Marque générique par excellence, le nom « caddie » est couramment utilisé pour désigner les chariots de supermarchés. On pourrait penser qu’avec un taux de notoriété spontané d’au moins 95 %, la marque monopoliserait son marché et se porterait très bien. Or, cela ne l’a pas empêché d’être mise en redressement judiciaire en 2012 à cause de problèmes de trésorerie. Depuis, l’entreprise s’est faite racheter, ce qui a permis une diversification de la gamme avec des chariots dans les aéroports ou les hôpitaux par exemple. Malgré la variété de marques de chariots sur le marché, Caddie reste une marque française emblématique.

Sopalin
Déposée en 1948 par la société française « Société du Papier Linge », la marque Sopalin est en fait une contraction des premières lettres de la société : « So-pa-lin ». Très vite appréciée par les familles françaises puis à l’international, la marque Sopalin devient un mot couramment utilisé pour designer un essuie-tout. Cela pose problème à la concurrence qui aimerait utiliser le nom Sopalin pour vendre leur produit sous leur propre marque. Mais la justice a toujours donné raison à la marque Sopalin qui conserve toujours son statut de marque.

Non non, ce n’est pas une erreur, Coton-Tige est une marque déposée par la multinationale Unilever depuis 1952. Le nom de la marque est tellement utilisé dans le langage courant que même le service juridique d’Unilever France l’ignorait ! Les concurrents doivent donc employer le terme « bâtonnet ouaté ». Aux Etats-Unis, la marque déposée est Q-Tips, marque générique, qui est également devenu un mot commun en anglais.

Commercialisée à partir de 1980 par l’entreprise américaine 3M, la marque Post-it est également utilisée comme nom pour désigner un petit bloc note autoadhésif. Même si la marque appartient toujours à 3M, le brevet de base est entré dans le domaine public en 2000.

Créée en 1918 par General Motors aux Etats-Unis puis vendue à Electrolux, le nom de la marque générique Frigidaire est utilisé comme synonyme de réfrigérateur. Frigidaire est d’ailleurs lui-même familièrement appelé frigo, qui n’est pas protégé. Si aujourd’hui la marque n’est plus vendue en France, elle est toujours exploitée aux Etats-Unis.

Piña colada
L’origine de la recette n’est pas bien définie mais elle date d’avant 1954, et elle a été déclarée boisson nationale à Porto Rico en 1978. C’est en 1974 que Piña colada devient une marque déposée appartenant à Bardinet.
Mais de plus en plus utilisé dans les bars et restaurants en dehors de la France, le concurrent Ego Fruits poursuit en justice Bardinet afin de pouvoir utiliser le nom Piña Colada. La justice considérant que Bardinet est restée passive face à l’emploi généralisé de l’expression « Piña Colada », l’entreprise se voit donc déchu de ses droits sur la marque. Depuis 2004, elle n’est donc plus considéré comme une marque déposée. C’est un des dangers qu’une marque générique peut faire face.

Tout comme Post-It, la marque Scotch appartient à la société américaine 3M depuis 1930. Entré dans le langage français courant, on utilise le nom de la marque pour désigner du ruban adhésif. Mais sous cette marque, en plus des produits adhésifs, il est également commercialisé des produits de bureau comme des paires de ciseaux des colles, etc.
En conclusion, pour une marque, le fait de devenir générique peut lui donner des avantages comme le fait d’avoir un taux de notoriété élevé et d’être leader sur son marché. Mais cela peut aussi lui donner des inconvénients tels que la perte du monopole d’utilisation de son nom qui peut entrainer une déchéance de sa marque. Il faut donc qu’une marque générique fasse attention à l’utilisation de son nom et bien la protéger, si elle souhaite la conserver.
